GENERAL TERMS IMEDIAAL

These terms and conditions ("Terms") apply to all agreements, services, and use of the website of Imediaal, located at Kolmstraat 44, 9750 Zingem, Belgium. By using our services or website, you agree to these Terms.
DEFINITIONS
Imediaal: Lander Taerwe, acting under the name Imediaal, with registered office in Belgium.
Customer: The natural person or legal entity that uses the services or products of Imediaal.
Agreement: The binding arrangement between Imediaal and the Customer.
Services: All services provided by Imediaal, including marketing services, photography, videography, and advertisements.

APPLICABILITY
2.1 These Terms and Conditions apply to all offers, quotations, invoices, services, and agreements between Imediaal and the Customer.
2.2 Deviations from these Terms and Conditions are only valid if they have been agreed upon in writing.
2.3 The Terms and Conditions are always accessible via the Imediaal website.
QUOTES AND AGREEMENTS
3.1 All quotes are non-binding and valid for 30 days from the date of issue, unless stated otherwise.
3.2 The contract comes into effect after written or electronic confirmation by the Customer.
3.3 Imediaal reserves the right to refuse assignments without stating reasons.
PRICES AND PAYMENTS
4.1 All prices are stated in euros and exclude VAT, unless stated otherwise.
4.2 Invoices must be paid within 14 days of the invoice date, unless agreed otherwise in writing.
4.3 In case of late payment, the Customer is automatically liable for a late payment interest of 8% per month, as well as a fixed compensation of 10% of the outstanding amount with a minimum of €100.
4.4 Complaints about invoices must be reported in writing within 7 days of receipt.
CUSTOMER OBLIGATIONS
5.1 The Client must provide all necessary information in a timely and accurate manner that is required for the execution of the services.
5.2 The Client is responsible for the accuracy and completeness of the provided information.
5.3 If a delay occurs due to incorrect or incomplete information, Imediaal may charge the additional costs.

6.1 Immediately strives to provide the services to the best of its ability and with professional care.
6.2 Timelines for the execution of services are indicative and non-binding. Delay does not entitle the right to compensation or cancellation of the agreement.
Cancellation and Termination
7.1 The Customer may only cancel the Agreement in writing. In the case of cancellation after the commencement of the work, the Customer is obliged to reimburse all services already provided and costs incurred.
7.2 Imediaal may terminate the Agreement in the event of non-payment or serious breach of these Terms by the Customer.
Liability
8.1 Imediaal is solely liable for direct damage caused by intent or gross negligence.
8.2 Imediaal is not liable for:
Indirect damage such as lost profits, consequential damage or loss of data.
Delays caused by third parties or unforeseen circumstances.
8.3 The total liability is limited to the amount that the Customer has paid for the relevant service.
Intellectual Property
9.1 All materials, designs, photographs, videos, and other works provided by Imediaal remain the property of Imediaal, unless otherwise agreed in writing.
9.2 The Customer only obtains a right of use and may not resell, reproduce, or modify these materials without permission.
Privacy and Data Protection
10.1 Immediately processed personal data in accordance with the Privacy Policy, in compliance with GDPR legislation.
10.2 The Customer consents to the processing of necessary data for the execution of the Agreement.
Applicable Law and Disputes
11.1 These Terms are governed by Belgian law.
11.2 Disputes that cannot be resolved amicably shall be submitted to the competent court of the district where Imediaal is based.
